As a “Data Controller”, Jazz Lounge Seaside CIC has chosen what data to collect and decided how it will be handled.  Jazz Lounge Seaside CIC are committed to protecting your privacy, as users and customers, when you visit our “Site” or use our “Services”.
This policy sets out to explain our privacy practices and to help you understand your privacy choices.
‘We’, Jazz Lounge Seaside CIC, may collect, retain, process, share and transfer is administered in accordance with the EU General Data Protection Regulation (GDPR) 2016/679 and UK national laws implementing “GDPR” and any parliamentary legislation that replaces it in whole or in part and any other related legislation.

2.    WHAT INFORMATION DO WE COLLECT WHEN YOU VISIT OUR ‘SITE’ OR USE OUR ‘SERVICES’?


In-order to provide you with the “Services” when you visit our “Site”, We must collect “Personal Data” relating to an identified or identifiable natural person.  We collect “Personal Data” you provide us, from your use of the “Services”, and from other sources. 
The types of information We collect about you to provide you with the “Services” when you visit our “Site” are such as your name, postcode, email address, mobile phone number, date of birth (month and year only), credit, debit, or PayPal account details.
We may collect this indirectly, for example, when you:
(a)    correspond with us by email, in which case We may retain the content of your email messages and any scanned identification documents (such as an ID card, driver’s license, passport, or official company registration documents), together with your email address and our responses; and

(b)    use our mobile optimised website from your portable hand-held device including details of your physical location, where you have agreed to it being used.
Other information We collect when you use you visit, download, and/or use any of our “Services”, We may collect aggregated usage, such as Visitors’ and Users’ browsing and ‘click-stream’ activity on the “Site”, session heatmaps and scrolls, non-identifying “Personal Data” regarding the Visitor’s or User’s device, operating system, internet browser, screen resolution, language and keyboard settings, internet service provider, referring/exit pages, date/time stamps, etc.
Information We collect from other sources about you, from third-party sources, such as:
i.    security providers, fraud detection and prevention providers for example to help us screen out users associated with fraud;
ii.    social media platforms, when you log-in or sign-up using your social media account, We may receive information from that service (e.g., your username, basic profile Personal Information) and in some cases, We may collect “Personal Data” from lead enhancement companies which help us to improve our service offering; and
iii.    advertising and marketing partners in order to monitor, manage and measure our ad campaigns.

3.    WHY DO WE COLLECT SUCH ‘PERSONAL DATA’ AND FOR WHAT PURPOSE?


We collect “Personal Data” in an identifiable format for the least amount of time necessary to fulfil our legal or regulatory obligations and for our business purposes.
For our compliance to the General Data Protection Regulation (GDPR), We are obliged by law to disclose your information to a regulatory body or law enforcement agency upon request.
For our legitimate business purposes, We use the information to provide you with the “Services” when you visit our “Site”; to further develop, customise, expand, and improve our “Services”, based on users’ common or personal preferences, experiences and difficulties; initiate a payment or send a refund related to our “Services”; perform financial standing checks, evaluate applications, and compare information for accuracy and verification purposes; manage risk and protect the “Site”, the “Services” and you from fraud by verifying your identity.
For our legitimate our interests, We use the information to provide users of our “Site” with ongoing customer assistance and technical support; create aggregated statistical data and other aggregated and/or inferred information, which We use to provide and improve our respective “Services”.

Yes, We do.  In certain circumstances We will share your Information with other parties.  Of note, when We receive a request from a regulatory body or law enforcement agency, and if permitted under GDPR and other laws, We will disclose certain personal information to such bodies or agencies.
Sharing of your “Personal Data” will only be undertaken in accordance relevant Model Standard Contractual Clauses that are in place. Details of those parties are set out below along with the reasons for sharing it.
With other companies that provide services to us: We share “Personal Data” with third-party service providers that perform services and functions at our direction and on our behalf, for example, PayPal Holdings Incorporated and Wix.com Ltd. These third-party service providers may, for example, provide you with “Services” by verifying your identity, assist in processing transactions, provide customer support.
We may share your “Personal Data” with members of the PayPal family of entities to, among other things, provide the “Services” you have requested or authorised; to manage risk; to help detect and prevent potentially illegal and fraudulent acts and other violations of our policies and agreements and to help us manage the availability and connectivity of PayPal products, services, and communications.
We may share with Wix.com Ltd, Wix.com subsidiaries and affiliated companies, and their third-party services providers the following categories of your “Personal Data” for business purposes, such as: identifiers, including name, alias, postal address, unique personal identifier, online identifier, internet protocol address, email address, account name, or other similar identifiers.
We may share your “Personal Data” if Jazz Lounge Seaside CIC merges with or is acquired by another business or company.  If this happens, you will be sent notice of such change in ownership.

5.    WHERE DO WE STORE AND HOW LONG DO WE HOLD YOUR ‘PERSONAL DATA’?


Our “Site” is built-off and runs on the Wix.com Ltd international World Wide Web (www) server.
Wix.com Ltd. is based in Israel, which is considered by the European Commission to be offering an adequate level of protection for the Personal Information of EU Member State residents.
Wix.com Ltd may store and process “Personal Data” in the United States of America, Ireland, South Korea, Taiwan and Israel, or other jurisdictions, whether by ourselves or with the help of our affiliates and service providers.  Wix.com Ltd data storage providers are contractually committed to protect and secure your data.  Wix.com Ltd ensures that there is the adequate level of protection or that relevant Model Standard Contractual Clauses are in place for the international transfer of our users’ data.
Our "Services” are operated from the PayPal Holdings Incorporated online payments system.
PayPal’s network is built on a financial infrastructure of bank accounts and credit cards to create a global, real-time payment solution.
PayPal (Europe) S.à r.l. et Cie, S.C.A. is duly licenced as a Luxembourg credit institution in the sense of Article 2 of the law of 5 April 1993 on the financial sector as amended and is under the prudential supervision of the Luxembourg supervisory authority, the Commission de Surveillance du Secteur Financier, with registered office in L-1150 Luxembourg.
PayPal is deemed authorised and regulated by the Financial Conduct Authority (FCA) UK.
The nature and extent of consumer protections may differ from those for firms based in the UK.
Details of the Temporary Permissions Regime, which allows EEA-based firms to operate in the UK for a limited period while seeking full authorisation, are available on the Financial Conduct Authority’s website.
PayPal maintain technical, physical, and administrative security measures designed to provide reasonable protection for your “Personal Data” against loss, misuse, unauthorised access, disclosure, and alteration. Their security measures include firewalls, data encryption, physical access controls to our data centres, and information access authorisation controls.
Jazz Lounge Seaside CIC will only retain your “Personal Data” for as long as is necessary for the purpose or purposes for which We have collected it.
The criteria that We use to determine retention periods will be determined by the nature of the data and the purposes for which it is kept.  For example, in certain circumstances, once We have deleted or anonymised your “Personal Data”, We may need to retain parts of it (for example, your email address), in order to comply with our obligations under GDPR or other legislation, or for fraud detection purposes.

6.    WHAT ARE YOUR RIGHTS IN RELATION TO YOUR ‘PERSONAL DATA’?


Subject to limitations set out in EEA and UK data protection laws, you have certain rights in respect of your “Personal Data”.  In particular, you have a right of access, rectification, objection, restriction, erasure, data portability and consent.
You can exercise any of the above rights by contacting us at the address or e-mail address set out above.  You can exercise your rights free of charge.  Most of the above rights are subject to limitations and exceptions.  We will provide reasons if We are unable to comply with any request for the exercise of your rights.  We will require evidence of your identity before We are able to act on your request.
I.    Right of Access: you have the right at any time to ask us for a copy of the data about you that We hold, and to confirm the nature of the Information and how it is used.  Where We have good reason, and if the GDPR permits, We can refuse your request for a copy of your Information, or certain elements of the request.  If We refuse your request or any element of it, We will provide you with our reasons for doing so.

II.    Right of Rectification or Completion: if data We hold about you is not accurate, or is out of date or incomplete, and requires amendment or correction you have a right to have the data rectified, updated or completed.  You can let us know by contacting us at the address or email address set out above.

III.    Right to Object to or Restrict Processing: in certain circumstances, you have the right to object to our processing of your Information by contacting us at the address or email address set out above.  For example, if We are processing your data on the basis of our legitimate interests and there are no compelling legitimate grounds for our processing which override your rights and interests.   You also have the right to object to use of your Information for direct marketing purposes.

IV.    You may also have the right to restrict our use of your Information, such as in circumstances where you have challenged the accuracy of the data and during the period where We are verifying its accuracy.

V.    Right of Erasure: in certain circumstances, you have the right to request that Information We hold about you is erased.  For example, if the data is no longer necessary for the purposes for which it was collected or processed or our processing of the data is based on your consent and there are no other legal grounds on which We may process the data.

VI.    Right of Data Portability: in certain instances, you have a right to receive any Information that We hold about you in a structured, commonly used and machine-readable format.  You can ask us to transmit that Information to you or directly to a third-party organisation.

VII.    This right exists in respect of Information that:
•    you have provided to us previously; and
•    is processed by us using automated means.

VIII.    While We are happy for such requests to be made, We are not able to guarantee technical compatibility with a third-party organisation's systems.  We are also unable to comply with requests that relate to Information of others without their consent. 

IX.    Consent: to the extent that We are processing your Information based on your consent, you have the right to withdraw your consent at any time.  You can do this by unsubscribing via the link provided in any direct marketing communication, or contacting us at the address or email address set out above.

8.    WHAT ELSE SHOULD YOU KNOW ABOUT OUR PRIVACY POLICY?


Jazz Lounge Seaside CIC reserves the right to change this Privacy Policy from time to time to reflect changes to our business, the “Site”, the “Services” and applicable laws.
The revised Privacy Policy will be effective as of the published effective date.
If We change our Privacy Policy in the future, We will advise you of material changes or updates by e-mail, where We are holding your e-mail address.
